This website is operated by Envita GmbH, Bahnhofstraße 26, 36110 Schlitz, Germany, registered with the commercial register of the Local Court (Amtsgericht) of Gießen under HRB 12226 (“Envita”, “we”). These Terms of Use govern your use of this website.

1.         Scope

1.1        These Terms of Use govern the use of this website and its content only. They do not govern the purchase of Envita products or the use of Envita software and data services.

1.2        The purchase of Envita products and related services directly from Envita is governed by the Envita Sales Terms (envita.ch/sales-terms). The use of Envita’s cloud software and data services is governed by the Envita Service Terms (envita.ch/service-terms), which users accept when creating their account. Authorised Envita resellers purchase under a separate Reseller Agreement.

1.3        In the event of any conflict between these Terms of Use and the Sales Terms, the Service Terms, a Reseller Agreement or any other contract concluded with Envita, the terms of that other document prevail.

2.         Website Content and Intellectual Property

2.1        All content on this website — including text, images, graphics, logos, trademarks, product documentation and software — is owned by Envita or its licensors and is protected by copyright, trademark and other intellectual property laws.

2.2        You may view, download and print content from this website for your own information and for evaluating or using Envita products. Any other reproduction, distribution, modification or commercial use requires Envita’s prior written consent. Statutory rights that cannot be excluded (such as the right to quote) remain unaffected.

3.         Product Information

Product descriptions, specifications and prices shown on this website are for general information only and do not constitute a binding offer. Specifications may change without notice; the binding scope of delivery, specifications and prices are those stated in an individual offer or order confirmation from Envita.

4.         Acceptable Use

4.1        You may use this website only for lawful purposes. You must not introduce malware or other harmful code; attempt to gain unauthorised access to the website or the systems behind it; carry out systematic or automated data collection (such as scraping) without Envita’s consent; or interfere with the operation, performance or availability of the website.

4.2       Envita may restrict or terminate access to the website in the event of misuse, and may modify or discontinue the website or parts of it at any time.

5.         Third-Party Links

This website may contain links to third-party websites. Envita does not control these websites and is not responsible for their content or privacy practices; your use of them is subject to those third parties’ own terms.

6.         No Warranty; No Advice

The content of this website is provided for general information. It may contain inaccuracies or typographical errors, and Envita does not warrant that the website will be available without interruption or error. Nothing on this website constitutes technical, legal, financial or other professional advice.

7.         Liability

As this website is provided free of charge, Envita is liable in connection with its use only for damage caused intentionally or by gross negligence, for culpable injury to life, body or health, and where liability is mandatory by law (including under the German Product Liability Act). Any further liability arising from the use of this website is excluded. Liability under a contract concluded with Envita (such as under the Sales Terms, the Service Terms or a Reseller Agreement) is governed exclusively by that contract.

8.         Unsolicited Ideas

If you send Envita unsolicited ideas, proposals or materials without a prior written agreement (such as a non-disclosure agreement), Envita does not assume any confidentiality obligation with regard to them.

9.         Changes

Envita may update these Terms of Use from time to time. The version published on this page applies; the date of the last revision is shown above.

10.       Governing Law and Final Provisions

10.1      These Terms of Use are governed by the laws of the Federal Republic of Germany. If you use this website as a consumer, mandatory consumer protection provisions of your country of residence remain unaffected.

10.2      If you are a merchant (Kaufmann), a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from the use of this website is Envita’s registered seat.

10.3      Should any provision of these Terms of Use be or become invalid, the remaining provisions shall not be affected. These Terms of Use are drawn up in English; where translations are provided, the English version prevails.
